Visa Categories

The different visa categories that Azerbaijani citizens can apply for entering Argentina are set forth in the Law No. 25,871 (Argentine National Migration Law), Decree No. 616/2010 and relevant provisions of the National Migration Authority (DNM).

 

The following categories of visas/residencies are set forth in Law No. 25.871.

 

PERMANENT RESIDENTS

Article 22.- It will be considered as a "permanent resident" every foreigner that has the purpose of establishing permanently in the country and obtains such admission from the National Migration Authority.

The foreigner applying for permanent residency must prove:

(a) To be the spouse, parent or child of an Argentine citizen.

(b) To be the spouse, parent, or unmarried child under the age of EIGHTEEN (18) of a permanent resident.

 

TEMPORARY RESIDENTS

ARTICLE 23. — It will be considered as temporary residents all those foreigners that, under the conditions that the regulations will establish, enter to the country in the following subcategories:

L) NATIONALITY (MERCOSUR VISA): Natives Citizens of the States members of MERCOSUR and States associated of MERCOSUR.

• OTHER SUB-CATEGORIES:

Article 23 “In fine”) FAMILY REUNIFICATION: the one who proves to be the spouse, parent or unmarried child under the age of EIGHTEEN (18) , of an immigrant with temporary residence.

(a) MIGRANT WORKER: those who enter to the country in order to work in a gainful and lawful employment, with permission to be employed under a relation of dependence pursuant to Argentine legislation.

(b) A person with earned income: who will afford the staying in the country with his own resources brought from a foreign country, or the profits that such resources produce or any other lawful income originated from external resources.

 (c) PENSIONER: who perceives a pension from a government, international institutions or private companies for services provided in a foreign country, enough to ensure a regular and permanent pecuniary income in the country.

d) INVESTOR: who will invest his own property in order to carry out activities of the interest to the country.

(e) SCIENTISTS AND SPECIALIZED STAFF: those engaged in scientific, research, technical, or advisory activities, hired by public or private entities to perform jobs in their specialty. In the same way, directors, technicians and administrative staff of public and private foreign entities of commercial and industrial kind, transferred from a foreign country to Argentina with the purpose of covering specific positions in their companies (such transferred staff must earn fees or wages in the Argentine Republic).

f) ATHLETES AND ARTISTS: signed by individuals and companies that carry out their activities in the country.

g) RELIGIOUS: Members of an officially recognized worship entity, with legal personality granted by the Ministry of Foreign Affairs, International Trade and Worship, who enter the country with the aim of carrying out activities related to such worship entity.

(h) Patients with medical treatments: that enter Argentina to deal with health problems in public or private medical institutions.

 (i) ACADEMICS: for those who enter the country pursuant to academic agreements entered into by institutions of higher education in specialized areas, under the responsibility of the Argentine institution party to the contract.

(j)STUDENTS: that enter the country to study as regular students in officially recognized public or private educational establishments.

 

TRANSITORY RESIDENTS

ARTICLE 24. — Foreigners that enter the country as transitory residents under one of the following subcategories:

a) Tourists: those who enter with purpose of rest or leisure.
 

h) Special:
• Scientific, Professional, Technical, Religious, or Artist (Pursuant to DNM Resolution No. 1170/2010): those who enter Argentina with the aim of carrying out scientific, professional, technical, religious, or artistic activities, whether paid or unpaid.

• Business (Pursuant to DNM Resolution No. 1171/2010): Those that intend to carry out business activities on their own or on behalf of other people or companies.

• Market research and attending conferences (Pursuant to DNM Resolution No.2692/2011): those who enter the country temporarily to visit trade fairs, congresses, exhibitions and/or to conduct market research.

• International students (Pursuant to DNM Resolution No. 2802/2023): those who enter the country temporarily to participate in educational or academic activities; cultural or student exchange programs; internships; or scholarships in National Public Bodies or officially recognized educational institutions.

• Journalists: those who enter the country temporarily to perform journalistic works.

 

- OTHER SUB-CATEGORIES:

b) Passengers in transit: will be differentiated from here four situations:

c) Borderline neighborhood transit.

d) International Transport Crew.

e) Seasonal Migrant Workers: those who enter with the purpose of performing a work that depends on seasonal conditions and can only carried out during a specific part of the year because of its very nature.

f) Academic: those who enter the country temporarily on the basis of academic agreements concluded between institutions of higher education in specialized areas, under responsibility of the Argentine educational establishment.

g) Medical Treatment: those who enter temporarily to the country to address health issues in public or private health facilities.

h) Special/ Students: those who enter the country temporarily in order to take formal or non-formal courses in officially recognized public or private educational institutions.
